Article 1: Preamble
- The Customer declares that he/she has full legal capacity to
commit himself/herself under these Terms and Conditions, i.e.
to be at least 18 years old and not under guardianship or
curatorship. - The Customer declares that he/she is reserving services on a personal and private basis,
or, where applicable, benefiting on a private basis from a personal reservation
within a group reservation (several individuals
, associations, companies, works councils or other). - The Customer, both for himself and for any other participant in the
stay, certifies the accuracy and sincerity of the information that he
provides for the proper execution of the said stay. They also certify
that they have given their consent to the communication and processing of
their personal data by ALPIZEN*. - The booking of any holiday implies unreserved acceptance,
by the customer as well as by any other participant, of the present
General Terms and Conditions of Sale, which he acknowledges having read
before validating his booking. The present
General Terms and Conditions of Sale form an integral part of the contract and
complete the prior information required by article R211-4 of the
Tourism Code.
Article 2: Definitions
- "Customer": the person who books or on whose behalf it is booked
an accommodation, catering and Resourcing Package or an external
Cure with the Alpizen* center. - "Curiste": person receiving Wellness treatments as part of a
accommodation, catering and Resourcing package or an outpatient Cure. - "Non-curist companion": person accompanying the Curist, who has
not booked a Healing package and is staying in the same room
as the Curist. "Cure Package": includes accommodation in one of the
rooms at the Alpizen* center, as well as a meal option in a small restaurant.breakfast, half or full board and one or more treatments from
Ressourcement.- "Outpatient Cure": one or more
treatments without accommodation or catering. - Center Alpizen*: refers together or separately to the
accommodation and catering facilities and the resource center. - Travel Agent/Provider: reseller with commercial agreements
with Alpizen* and authorized to sell these services. - Early booking" offer: promotional operation which allows you to benefit
from a reduction in price when the reservation of an accommodation package,
catering and Ressourcement or a 3-day or 6-day external Cure is
made at least 60 days before the start date of the stay, with a
commitment that cannot be modified and payment in full at the time of reservation. This
offer cannot be combined with other current offers. - bon plan" offer: promotional operation offering a
price reduction when the reservation of an accommodation package, a
catering and Ressourcement package or a 3-day or 6-day outpatient cure is made
between 60 and 7 days before the start date of the stay, with a
commitment that cannot be modified and payment in full at the time of reservation. This
offer cannot be combined with any other current offer or
promotional operation giving rise to the application of a one-off
price reduction. - Flash" offers: promotional operations giving rise to the application
of a one-off price reduction, with a non-modifiable commitment and
the payment of a 50% deposit or prepayment in full of the Package at
the time of booking, depending on the offer chosen. These offers cannot be combined with
other current offers.
Article 3: Contents
- These General Terms and Conditions of Sale define the rights and
obligations of the Parties in connection with the booking of
accommodation, catering and Resourcing packages, or External Cures offered by
Alpizen*. Promotional offers such as "early booking", "bon plan" and
"flash" are subject to special conditions as specified
. - The present General Terms and Conditions of Sale may be modified at any
time, without prior notice. These modifications will not apply to
reservations made previously. Only the General Terms and Conditions of
Sale in force at the time of booking are binding on the Customer.
Article 4: Services offered by Alpizen*
- The services offered by Alpizen* are detailed in the offers on the
website https://www.alpizen.fr and in the corresponding
price brochures; - All accommodation, catering and Resourcing packages are
breakfast, half-board or full-board. They do not include
beverages, tourist taxes and any additional
services that the customer may wish to take advantage of during his/her
stay (complementary treatments, laundry, etc.). - The Accompanying non curist rate is valid only for
persons sharing a curist's room. Accompanying persons who are not
curists on a stay with accommodation may access the relaxation area and the
swimming pool (depending on the season and the specific conditions mentioned in the
"Frequently asked questions" section and in the Alpizen* center brochure,
accessible on the dedicated https://www.alpizen.fr website page or by written request at
). - Breakfast and meal times will be indicated at the start of your stay and
may be subject to change without notice. - Languages spoken at Alpizen*: French, English and Italian.
Article 5: Conditions for children, babies and mothers-to-be
- The Alpizen* center is not accessible to minors.
- The Alpizen* center offers treatments accessible to pregnant women. These
Resourcing treatments are provided subject to presentation of a
medical certificate in accordance with the specific conditions of the Alpizen* center
mentioned in the brochures, hereafter in article 12 of our GTC and
available on the website https://www.alpizen.fr.
Article 6: Accessibility - People with reduced mobility
- The Alpizen* center has set up a room accessible to people with
Reduced Mobility. Individual treatments can be carried out in this
dedicated room. - Guests with reduced mobility are invited to contact
center Alpizen* to check the availability of rooms accessible to them, before
making a reservation.
Article 7: Prices
The Customer guarantees that he/she is fully authorized to use the
payment method provided to pay for his/her order, and that this method gives access tosufficient funds to cover all costs arising from the purchase of its
service.- Except in the case of special promotional offers, the applicable rates are those shown
in the Alpizen* brochure and on the dedicated
https://www.alpizen.fr website, in force at the time of
booking. - Prices are shown in euros, inclusive of VAT, and are valid
only for the dates indicated on the booking confirmation. - Prices include VAT applicable on the date of booking and any
change in the VAT rate will be automatically reflected in
the prices indicated. - Unless otherwise stated in the holiday description, the
prices shown do not include the following optional services and charges:
- tourist tax ;
- medical fees** (except in the case of cures
d'Experts and Inoubliables, where the medical visit is included in the advertised price);
- insurance ;
- catering services not included in the chosen package;
- beverages ;
- activities not included in the chosen package (details of these activities and prices
available on request from the Alpizen center*);
- Additional services (laundry, etc.) (rates available on request
from the Alpizen* center);
- and in general, all personal expenses not included in the
package.
Article 7: Prices
Reservations can be made :

Article 9: Booking confirmation
Once the order has been placed, the customer receives confirmation of the reservation.
Confirmation of the customer's reservation by the Alpizen* center is
subject to receipt of the price of the services in accordance with the terms and conditions
defined in article 10.- The booking confirmation summarizes the services ordered and
the corresponding prices.
Article 10: Payment of services
- For accommodation, catering and resourcing packages, as well as
external cures, and except for special offers requiring payment of the full
amount of the service at the time of booking
(in particular, flash offers, "early booking" and "bon plan" offers), the
Customer must pay at least a deposit of 30% or 50% of the total
amount of the package at the time of booking; the balance of the package and any
extras must be paid on site, at the Alpizen center, before
departure:
- at the end of your stay if it does not exceed 7 days,
- or every 7 days and before the Customer's departure at the end of the stay, prorated for
time spent, if the latter exceeds 7 days. Alternatively, the customer may choose to pay
in full at the time of booking.
- Any service not used will not be reimbursed.
- Payment can be made: by cheque, by bank transfer
or by credit card (Carte Bleue, Visa, American Express, Master
Card/Eurocard) whose holder is the reserving party. Reservations made
by internet are payable by credit card only. In the case of
payment by credit card, the customer acknowledges having given
authorization to debit the corresponding amount.
Article 11: External services
- Articles 9 and 10 above are not applicable in the case of
booking on the internet via the Alpizen website or a
website of a commercial intermediary, Travel Agent/Provider
having an agreement in force with the Alpizen* center concerned. The conditions
and terms of booking and payment applicable are those proposed
by the said travel site. In any case, before the start date of
stay or outpatient Cure, the Customer must have a "Voucher" from the Agent ofTravel/Online Service Provider from whom he/she will have paid for the service
corresponding to the reservation.
Article 12: Medical check-ups and state of health
Pregnant women are advised to consult their doctor before
making any reservation, to confirm that they are fit to receive the
treatments available and to practice a relaxation activity using the equipment provided
in the relaxation area. It is the customer's responsibility to
specify her pregnancy status when booking.- The medical examination or the medical certificate presented by the Curist determines the
capacity of the Curist to carry out the reserved service. - The presentation of a medical certificate by the Curiste is recommended for
any cure lasting three days or more. In all cases, a
health questionnaire will be completed at the start of the stay. - In general, Alpizen* cannot be held
responsible in the event of misuse of the relaxation equipment,
poor execution of the cure by the Customer, impossibility of carrying out
the cure in whole or in part, or of receiving treatment due to the Customer's state of health
, and no reimbursement or claim for compensation
may be made as a result. - A relaxation room is available to customers during their stay. The
Customer acknowledges that he/she is aware of the possible risks involved in using
the facilities to which he/she has access in the relaxation room. The
center Alpizen* cannot be held liable for
any damage of any nature whatsoever, following an accident
resulting from the Customer's failure to observe safety rules or
inappropriate use of the equipment and/or facilities. - The main therapeutic contraindications to
Ressourcement & Spa treatments are :
- pregnancy or breastfeeding
- lack of autonomy without a caregiver
- surgery less than 3 months old
- untreated high blood pressure
- untreated depression
- recent trauma, recent fractures
- endocrine disease: unbalanced dysthyroidism
- infectious and contagious diseases (fever, sore throat, acute infections)
- unstabilized neurological diseases
- untreated venous disease
- psychiatric illness: if not stabilized
- untreated cardiovascular diseases and unstabilized
rhythm disorders
- cancer in progress or under treatment (chemotherapy, radiotherapy, aplasia)
- metastases or recurrence of cancer
- dermatological infection (recent wounds or scars that have not closed, oozing,
purulent, eczema, psoriasis, chronic unhealed shingles, varicose ulcers)
- cancer in remission
- untreated kidney disease,
- non-medically treated dermatological disease
- acute infection
For an exhaustive list of therapeutic contraindications, curists are invited to
obtain all relevant information from a doctor of their choice.
Article 13: Modification by the customer
- Please note that "early booking",
"bon plan" and "flash" promotional offers cannot be modified, cancelled or
refunded. - Subject to availability and acceptance by the Alpizen* center,
requests for modifications concerning the extension of the stay,
the increase in the number of people or the modification of one of the
services included in the initial Package will result in the invoicing of a
handling fee of 60€ TTC per stay booked for the Accommodation,
Catering and Resourcing Packages. Where applicable, the customer must pay
the difference in price between the initial Package and the new Package. Payment
of these additional costs must be made at the time of departure. - In the event that Alpizen* is unable to comply with requests for modifications,
Alpizen* cannot be held responsible. If the Customer wishes to cancel the reservation,
as a result, the cancellation conditions set out in article 14
will apply. - For any modification involving a reduction in the number of people, the
change of seasonality to a lower season or the deletion of a
of the services booked, the amount of the initial order remains due.
Article 14: Cancellation by the customer
In accordance with article L.221-28 12° of the French Consumer Code, customers are informed
that they do not have the right of withdrawal provided for in article L.221-18 of the French Consumer Code
. However, the Customer may cancel the Package at any time prior to the start of the
stay, subject to payment of a cancellation fee.
All cancellations must be made in writing (e-mail or registered letter
with acknowledgement of receipt) addressed to Alpizen at the address given below. The
cancellation will be effective on the date of receipt, by Alpizen, of the e-mail or registered letter
with acknowledgement of receipt.
14.1 Cancellation fees payable in the event of cancellation of an accommodation package
catering and resourcing
Cancellation fees will be payable by the customer in accordance with the following scale:
- More than 60 days before the start of the holiday: 100 euros incl. VAT;
- Between 60 and 21 days before the start of the holiday: the deposit
paid by the customer is retained; - Between 21 and 8 days before the start of the holiday: 75% of the total price
including VAT of the package; - Between 7 days and the start of the holiday: 100% of the total price (including VAT) of the
package;
Depending on the date of termination, Alpizen will proceed as follows:
- reimbursement of down-payments, less any costs incurred by the customer.
termination indemnities ;
- or, to retain the deposit paid in full ;
- or, when an invoice is sent, of the balance to be paid in accordance with the above schedule.
Please note that any administration and insurance fees are non-refundable.
14.2. Special conditions applicable to Packages subject to a
promotional offer ("Bon Plan", "Early Booking", "flash" or "Thematic" offer)
Any "Bon Plan", "Early Booking", "flash" or "Thematic" offer is non
modifiable and cannot be cancelled after it has been subscribed to. No
sum paid to Alpizen in the context of such an offer, including any
file and insurance fees, may be the subject of a partial or total refund.
14.3. Terms and conditions
Any request for cancellation must be sent to Alpizen* in writing
(e-mail or registered letter with acknowledgement of receipt) to the following address

Alpizen* informs its Customers of the existence of an insurance contract covering the
consequences of cancellation: possibility, on request and subject to conditions, of
contracting cancellation insurance by telephone with an Alpizen* advisor on 04
79 69 85 99 (cost of a standard call, call not surcharged). The insurance will cover
changes or cancellations caused by the customer as specified in articles 13 and 14.
The General Terms and Conditions of Sale for the cancellation insurance offered by Alpizen*
are available on request from Alpizen* advisors.
In accordance with the provisions of article L211-14 of the French Tourism Code, the customer
may cancel the contract before the start of the holiday without being subject to
any cancellation indemnities if exceptional and unavoidable circumstances,
occurring at the destination or in the immediate vicinity of the destination, have significant
consequences on the performance of the contract.
Article 15: Modification / Cancellation by Alpizen
- If, before the start of the holiday, Alpizen finds itself obliged to cancel or modify the
Package booked by the Customer, Alpizen will inform the Customer by registered letter
with acknowledgement of receipt, as soon as possible following the occurrence of the
causes justifying the cancellation or modification of the Package concerned. - Alpizen will then propose new dates for the
Package or a new Package. The Customer must then inform
Alpizen* of his choice as soon as possible. - If the Customer accepts a new Package or postpones the dates of his/her stay, no
compensation will be due. - In addition :
- if the price of the new Package is lower than that of the initial Package, the difference will be
deducted or reimbursed depending on the state of payment of the balance, on the date of the
modification.
- if the price of the new Package is higher than that of the initial Package, the difference
will be borne by Alpizen as compensation and settlement.
- If the Customer does not wish to postpone his stay or opt for a new Package, he
may request reimbursement of the deposit paid, as well as payment
of an indemnity equal to the cancellation indemnity that he would have had to pay
if the cancellation had occurred on the same date. It is
specified that if this cancellation is imposed by circumstances of force majeure
(as defined in article 1218 of the French Civil Code), the Customer may not claim
any compensation. - Where applicable, reimbursement will be made, at Alpizen's discretion, by crediting the Customer's bank account
or by bank cheque within 14 days at the latest
after the contract has been terminated.
Article 16: Transfer of the package
Any transfer of a care pack or package to a third party is subject
to the provisions of articles L211-11 and R211-7 of the Code de
tourisme, which state that :
The customer may assign his contract to a third party meeting the same conditions
as him to carry out the stay.
If this is the case, he must inform Alpizen* at the latest seven days before the
start date of the stay, imperatively in writing (e-mail or
by registered letter with acknowledgement of receipt) to the following address

A new contract will be drawn up in the name of the transferee.
The transferor and transferee will be jointly and severally liable for payment
of the balance of the price of the accommodation, catering and resourcing package transferred
as well as any fees, royalties or other additional costs
incurred as a result of this transfer.
In particular, any transfer of an accommodation, catering and
resourcing package will result in the invoicing of an administration fee of €60 including VAT.
Article 17: Hygiene measures - Internal regulations
- For reasons of hygiene, we recommend that you bring two
bathing suits. Swimming shorts are not permitted in swimming pools.
The
measures applicable to hygiene and safety at the Centre Alpizen are explained in greater detail in the "Frequently Asked Questions" section. - To access the relaxation areas, customers must comply with the
sanitary rules in force at the Centre Alpizen. - The Centre Alpizen has its own rules and regulations, which are sent out at the time of booking
and can be consulted on site. The customer undertakes to acquaint himself/herself with
before the start of his/her stay or when entering the center, and
undertakes to respect them. In any case, the Customer undertakes to use the
room and Alpizen services reasonably. In all circumstances,
proper dress is required. Any behavior or remarks contrary to
morality or public order will lead Alpizen to ask the Customer to
leave the center, without any reimbursement if payment has been made,
or compensation. The Customer undertakes not to invite any person whose behaviour
is likely to cause prejudice to the Alpizen center, which
reserves the right to intervene if necessary. The Customer may not
bring in any drinks or foodstuffs from outside.
The general ban on smoking in public places applies to
all rooms in the Centre Alpizen.
Article 18: Liability
- The services offered comply with French legislation
. Alpizen may not be held liable in the event of non
compliance with the legislation of a third country. - Alpizen cannot be held responsible for the non-execution or
poor execution of the reservation in the event of force majeure, or in the event of an act
by a third party or by the Customer. - The photographs, graphic representations, videographs and
narrations appearing on the www.alpizen.fr website are not
contractual. The Customer may not claim any complaint or
compensation as a result. - Alpizen is responsible for the proper execution of the services included in the
contract in accordance with article L.211-16 of the French Tourism Code and is required
to provide assistance to the Customer if he/she is in difficulty in accordance with article
L.211-17-1 of the French Tourism Code. - When an anomaly is noted during the stay, the Customer must
inform ALPIZEN in accordance with article R 211-6 5° of the French Tourism Code.
Article 19: Personal datas & GDPR
- The European Personal Data Protection Regulation (RGPD) entered
into force on May 25, 2018 extends and facilitates the exercise of the Customer's rights by
improving the transparency of the processing of their personal data. - For any request concerning customer data: The Customer may
send an e-mail, enclosing proof of identity, to
Délégué à la Protection des Données Personnelles (DPO) using the following address
: bienvenue@alpizen.fr.
Depending on the nature of the request, the procedure will be
different:
- In accordance with Article 15 paragraph 3 of the RGPD, the Customer has a right to
consultation of his personal data. After making his request by
email to the DPO, all the data concerning him will be
transmitted to him as an email attachment in PDF format within 48 hours (working days
).
- In accordance with Article 16 of the RGPD, the Customer has a right of rectification.
For his request to be processed, he must indicate the desired rectifications in
his contact email. Once the changes have been made, a confirmation e-mail
will be sent within 48 hours (working days).
- In accordance with Article 17 of the RGPD, the Customer has the right to be forgotten. To
proceed with the deletion of his personal data, the Customer must make his
request by email specifying the information he wishes to remove. An e-mail
requesting confirmation will be sent to him within 48 hours (working days)
before proceeding with any operation to destroy the personal data
concerning him.
- In accordance with Article 18 of the RGPD, the Customer has the right to request
limitation of processing. For his request to be processed, he must indicate the
desired limitations in his contact email. Once the
changes have been made, a confirmation email will be sent to him within
48h (working days).
- In accordance with Article 20 of the RGPD, the Customer has the right to request the
portability of his data. After making his request by email to
destination of the DPO, all the information concerning him will be transmitted to him or
will be transmitted to the person you indicate to us, as an attachment by email to
PDF format within 48 hours (working days).
Personal data collected by Alpizen :
- For all reservations made by telephone or e-mail, Alpizen collects: the Customer's
surname, first name, postal address, e-mail address,
landline telephone number, mobile telephone number, date of birth,
bank details, name and first name of other participant(s);
- For all Internet bookings from the https://www.alpizen.fr website, Alpizen
collects: the customer's surname, first name, postal address, e-mail address,
, landline telephone number, mobile telephone number, date of birth
, surname and first name of other participant(s).
- By means of the "contact form" accessible from the website,
https://www.Alpizen.fr and for any brochure request, Alpizen collects: the customer's
surname, first name, postal address, e-mail address,
landline telephone number, mobile telephone number.
- Alpizen is likely to collect the same personal data when they
are communicated during conversations with Alpizen consultants, via the
Chat module accessible from its https://www.alpizen.fr website, in addition to the city
from which the service user comes and his/her IP address.
- Alpizen may collect this same information through "
Customer follow-up forms sent before, during and after the stay". -
Alpizen may collect the same personal data from its external service providers
when the customer's reservation is made through them.
This data is required for commercial management for the following processes
:
-> Booking/confirmation: the information requested from the customer is
necessary to process the booking and will be recorded in Alpizen's
database. If no information is provided, Alpizen will not be able to process the
reservation.
->Customer satisfaction and follow-up
->Improved customer service and support
->Sending personalized information and promotional offers - Management
accounting - Statistical processing - To meet legal obligations or
regulations.
The personal data that the Customer communicates to Alpizen when placing an order
is neither sold nor transmitted to any third party. This information isconsidered by Alpizen to be confidential. It is used solely
by Alpizen's internal departments, in particular to process the customer's
order and to reinforce and personalize communication and the
services reserved for Alpizen customers.- Personal data is kept for 5 years from the date
of registration or 2 years after the last interaction with Alpizen services. - - The Customer has the option of expressly consenting to receive
direct canvassing by e-mail, post or
SMS. The Customer has the right to object, by e-mail or by
registered mail with acknowledgement of receipt, to the use of his
data for prospecting purposes, in particular for commercial purposes.
Article 20: Administrative formalities
- The Alpizen center is located in France. French customers
or European Union nationals must have a
national identity card valid for the entire duration of the
stay. Customers from outside the European Union are invited to
contact the embassy of their country to find out about the
steps to be taken to obtain the
administrative documents required to enter France (visa, etc.). - Alpizen cannot be held responsible for any refusal
to issue the required documents and will not, in this case, be obliged
to reimburse the Customer for the amount of the reservation.
Article 21: Intellectual property
- All texts, images and sounds reproduced on the Alpizen website
www.alpizen.fr are reserved as intellectual property for
worldwide. - The present General Terms and Conditions of Sale do not imply any transfer
of any kind of intellectual property rights on the
elements belonging to Alpizen or its assignees such as photographs, images,
literary texts, artistic works, trademarks, graphic charters, logos to
the benefit of the Customer. - Internet users who have a personal website and wish to place, for
personal purposes, a simple link on their site leading directly to the
home page of the www.alpizen.fr website, must obtain the prior express authorization of Alpizen to establish such a link.
. - In any event, hypertext links to the website
www.alpizen.fr must be removed at Alpizen's first request.
Article 22: How Alpizen handles complaints
- Consumers may submit their claims to the following address

necessary. - If no solution is found within 30 days of the
customer's complaint to Customer Services, the customer may refer the matter to a Mediator, whose contact details
are given in article 23 of these Terms and Conditions

Article 23: Referral to the Consumer Mediator
- In accordance with Articles L. 612-1 ° of the French Consumer Code, the
customer may have free recourse to the services of a mediator:

Article 24: Applicable law and settlement of disputes
- The applicable law is French law.
- In the event of a dispute, and in the absence of an amicable agreement between the parties, the
court will be the one with territorial jurisdiction.
